            How to Start a Business  in York County

A Step by Step Guide

1.  BUSINESS LICENSE - Business licenses are issued by the Commissioner of the Revenue.  A fee based on your business's first year's anticipated revenue will be charged.  At the end of the first year, the fee will be adjusted, based on actual revenue.  In succeeding years, you will be taxed on the preceding year's receipts.  All business licenses must be renewed by March 1 each year.  The tax year is January 1 through December 31.  If, when applying for a business license, the office feels there is an issue of concern, you will be advised whom to contact and why.  Contact the Commissioner of the Revenue, 120 Alexander Hamilton Boulevard.  Telephone - (757) 890-3383.

2.  ZONING & CODE ENFORCEMENT - This office will determine whether the proposed location for your business meets zoning requirements.  All businesses are required to file for zoning clearance, but that application is completed by the Commissioner of the Revenue's office and forwarded to the Department of Environmental & Development Services' Division of Development & Compliance for final approval.

Numbers 3-6 should be addressed ONLY if building or site improvements are anticipated and/or changes in current use of the building or site are anticipated by the new business.

3.  SITE PLAN - If you are constructing a new building or renovating an existing structure, you may need to prepare a site plan according to the York County Zoning Ordinance and submit it to the Department of Environmental & Development Services' Division of Development & Compliance which will coordinate with other County departments and agencies as needed.

The site plan must show parking spaces, building locations, lot lines, locations of dumpsters, traffic circulation, erosion and sediment control, stormwater management, landscaping, utilities, etc.  You may purchase a copy of the Zoning Ordinance from the Department of Financial & Management Services' Division of Planning.  The ordinance, and County employees, can explain the details of site plan requirements.  Contact the Department of Environmental & Development Services' Division of Development & Compliance, 105 Service Drive.  Telephone - (757) 890-3531.

4.  LAND DISTURBING ACTIVITY PERMIT - This permit pertains to erosion and sedimentation control and is required when the area of land disturbance will exceed 2,500 square feet.  Contact the Department of Environmental & Development Services, 103 Service Drive.  Telephone - (757) 890-3752.

5.  UTILITIES - It may be necessary to extend sewer or water lines to the site.  Contact the Department of Environmental & Development Services' Division of Utilities Operations & Engineering, 105 Service Drive.  Telephone - (757) 890-3752.

6.  BUILDING PERMIT - Plans for proposed new construction or renovation/alteration of existing buildings require issuance of a building permit.  Plans must be submitted for review and approval.  A fee, based on square footage for new construction, or a percentage of value for renovations, must be paid before issuance of the permit.  When all County departments, the Health Department and the Virginia Department of Transportation have approved the site plan and building plans, you can obtain a building permit to begin construction.

During construction, several inspections must be made to ensure that work underway meets County Building Code requirements.  New or renovated buildings may not be occupied until all inspections have been made and a Certificate of Occupancy has been issued.  Contact the Department of Environmental & Development Services' Division of Building Regulation, 103 Service Drive.  Telephone - (757) 890-3522.

7.  HEALTH DEPARTMENT PERMIT - If your business will prepare or serve foods in any way, you will need a permit from the Health Department.  Contact the Health Department, 416 J. OTHER IMPORTANT INFORMATION
  • New businesses with trade names are required to file a Fictitious Name Certificate with the Clerk of the Circuit Court prior to applying for a business license.  Telephone--890-3350.
  • Corporations and Partnerships are required to furnish a copy of their partnership agreement or Certificate of Incorporation when applying for a business license.
  • Federal Identification Numbers are required when you pay wages to one or more employees or if your company is a Partnership or Corporation.  Obtain Form SS-4 from the Commissioner's Office.  Telephone--890-3383.
  • Retail and Wholesale businesses shall apply with the Virginia Department of Taxation for a State Identification Number and to register for sales tax.  Telephone--594-7482.
  • Persons interested in providing Child Care should contact the Department of Social Services for state child care regulations.  Telephone--890-3787.
  • Virginia Alcohol Beverage Control licenses are required for businesses wishing to sell or serve alcoholic beverages.  Telephone--825-7830.
  • Certain Home Based Occupations are permitted by the Zoning Ordinance but are restricted to the type and extent of activity allowed.  "Zoning Clearance for Home Occupation Statement/Applications" are available in the Commissioner's Office.  Telephone--890-3383.
  • Sign permits (permanent and temporary signs) are available through the Department of Environmental & Development Services' Division of Building Regulation.  Business licenses must be applied for in the office of the Commissioner of the Revenue prior to the application and approval of such permit.
