Adjourned Meeting
March 13, 2001
6:30 p.m.
Meeting Convened. An Adjourned Meeting of the York County
Board of Supervisors was called to order at 6:30 p.m., Tuesday, March
13, 2001, in the East Room, York Hall, by Chairman James S. Burgett.
Attendance. The following members of the Board of
Supervisors were present: Walter C. Zaremba, Sheila S. Noll, Donald E.
Wiggins, and James S. Burgett.
H. R. Ashe was absent.
Also in attendance were James O. McReynolds, County Administrator;
and James E. Barnett, County Attorney.
PHASE II-WIRELESS E911 EFFORT (Not on Agenda)
Mr. McReynolds stated that the County entered into an agreement
some time ago for the implementation of the wireless E911 system, and
Phase I has now been completed. The County will be notifying the
providers that York is ready to begin implementing Phase II. He noted
that York County was the first locality in the state to implement Phase
I, and it will be the first to implement Phase II.
FUTURE WORK SESSIONS (Not on Agenda)
Mr. McReynolds indicated the following work sessions were
proposed, and he asked the Board members to let him know of any changes
so that they may be included in the Board's calendar:
April 24 - Joint Meeting with the Planning Commission
April 28 - Goals and Objectives Session
May 8 - Joint Meeting with the Industrial Development Authority
with
a
presentation on the Aviation's World Fair
A brief discussion followed regarding the Aviation's World Fair
and concerns of the residents as well as the responsibilities and
expectations of the County.
PROPOSED FISCAL YEAR 2002 BUDGET
Mr. McReynolds noted that at its meeting last evening the School
Board adopted its proposed budget for FY2002. He also noted the School
Board was very complimentary of the Board of Supervisors and its staff
for the support and additional funding provided over that which was
originally projected. He then reviewed the information packet provided
to the Board members on March 6 concerning the FY2002 General Fund
Summary showing changes from FY2001.
Mr. Ashe arrived at 6:36 p.m.
Mr. Zaremba asked what impact would the state shortfall have on
County operations.
Mr. McReynolds stated there would be level funding from the state,
so staff has anticipated no growth and the same funding from the state
as it received in FY2001. The staff does not expect any direct impact
from the Governor's budget, but the Board was cautioned that in some
areas the services that are not mandated may be at risk.
Mrs. Noll indicated she had found out today that the library
system was exempted from a proposed 15 percent reduction in library
funding.
Mr. Wiggins asked what were some of the non-mandated services.
Mrs. Anne B. Smith, Director of Community Services, stated that
everything in Social Services was mandated, but there was a General
Relief category that could be at risk. The majority of state funding is
pass-through money from the federal government in Medicaid, and state
mental health facilities are at risk. Other non-mandated areas that
could be affected are home repair and water projects for low income
residents.
Mr. Ashe mentioned the $148,000 for extra policemen and asked if
it was a declining amount.
Mr. McReynolds explained that it was. Over a three-year period the
funding will be phased out.
Mr. Ashe asked if there was funding in this program for assistance
to police officers for home financing within the community.
Mr. Wiggins indicated that program was through the Community
Criminal Justice Board.
Mr. McReynolds stated the County would probably be increasing the
staffing for the Sheriff's Office anyway. This program helps the County
pay the cost today.
Further discussion followed on the possible state shortfall for
non-mandated services because of the Governor's budget.
Mr. McReynolds then reviewed the expenditure side of the summary.
Discussion followed concerning the General Fund personnel costs
increases and the market adjustment and step increases. Also discussed
was the change in the funding formula for the Peninsula Alliance for
Economic Development.
Mrs. Noll asked if the County could expect any more funding from
the federal government because of the new census figures.
Mr. McReynolds indicated he did not think so, but there might be
some impact in 2003.
Mr. Zaremba stated he felt it was important to note that the
County has not changed its tax rate in the last seven years, but it
didn't mean the amount of taxes has not risen because of the assessments
that have taken place over the years.
Mr. McReynolds then reviewed the format of the budget documents
provided to the Board.
Mr. Zaremba inquired as to whether or not the budget information
as presented this evening was on the web site and whether or not other
jurisdictions had their information on the web.
Mr. McReynolds stated both budget documents were on the County's
web site for citizens to use, but he was not aware of what other
jurisdictions had done.
A brief discussion followed concerning the redistricting process
based on the new census figures.
CLOSED MEETING. At 7:44 p.m. Mr. Wiggins moved that the Board
convene in Closed Meeting in accordance with Section 2.1-344(a)(7) of
the Code of Virginia in order to consult with legal counsel on a
specific legal matter.
On roll call the vote was:

Meeting Reconvened. At 8:07 p.m. the meeting was reconvened
in open session by order of the Chair.
Mrs. Noll moved the adoption of proposed Resolution SR-1 that
reads:
A RESOLUTION TO CERTIFY COMPLIANCE WITH THE FREEDOM OF
INFORMATION ACT REGARDING MEETING IN CLOSED SESSION
WHEREAS, the York County Board of Supervisors has convened a
closed meeting on this date pursuant to an affirmative recorded vote and
in accordance with the provisions of the Virginia Freedom of Information
Act; and
WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a
certification by the York County Board of Supervisors that such closed
meeting was conducted in conformity with Virginia law;
NOW, THEREFORE, BE IT RESOLVED by the York County Board of
Supervisors this the 13th day of March, 2000, hereby certifies that, to
the best of each member's knowledge, (1) only public business matters
lawfully exempted from open meeting requirements by Virginia law were
discussed in the closed meeting to which this certification resolution
applies, and (2) only such public business matters as were identified in
the motion convening the closed meeting were heard, discussed, or
considered by the York County Board of Supervisors.

Meeting Adjourned. At 8:10 p.m. Mr. Ashe moved that the
meeting adjourned to 7:00 p.m., Thursday, March 15, 2001, in the Board
Room, York Hall, for the purpose of conducting public hearings on the
proposed FY2002 Budget and 2001 Tax Rates.
