ARTICLE I. IN GENERAL
Sec. 19-3. Violations and penalties.
(a) It shall be a violation of this
chapter for any person to throw, drop, deposit or otherwise dispose of any solid or
hazardous waste on any public or private property within the county except in accordance
with the provisions of this chapter. In additions to any other provisions of this chapter,
any person who fails to comply with any provision of this chapter after the date of
adoption shall be deemed to be in violation of this chapter. Each day that a violation
exists shall constitute a separate violation. The penalty for conviction of a violation of
any provision of this chapter shall be the imposition of a fine not exceeding one thousand
dollars ($1,000) or thirty (30) days imprisonment for each violation or both.
(b) The county may apply to the
county circuit court for injunctive relief to enjoin a violation or a threatened violation
of the terms of this chapter without the necessity of showing that there does not exist an
adequate remedy at law. |
