II. PERMITS, FEES AND INSPECTIONS
Sec. 7.1-12.
Certificate of use and occupancy.
(a) A building, structure, mechanism or assembly, or part thereof, subject
to the USBC when erected or installed shall not be used, occupied, operated
or considered complete until a certificate of use and occupancy has been
issued by the building code official.
(b) No certificate of occupancy shall be issued until a certification by a
licensed surveyor is presented to the building code official validating that
the final established lot elevations and grades are consistent with the
approved development plan and the plat plan submitted with the building
permit application.
(c) A temporary certificate of occupancy may be issued at the discretion of
the building code official and where such use or occupancy will not create
an unsafe, unusable, or unhealthy condition. The owner or contractor shall
execute a surety agreement with the building code official and provide a
bond or cash surety in the amount of any unfinished work or certifications
needed to obtain the final Certificate of Occupancy, in accordance with
Section 10-14 Erosion and Sediment Control, Code of the County of York.
